HOW TO ENTER.    If you are a 2007/2008 Sierra season pass holder, you are automatically entered in the Sweepstakes, unless you opt out as set forth below.  If you are not a 2007/2008 Sierra season pass holder, you may enter by writing your name, address, and telephone number on a 3" x 5" index card and mailing your entry to Early Load Sweepstakes, Sierra-at-Tahoe Resort, 1111 Sierra at Tahoe Road, Twin Bridges, CA 95735. Limit one entry per person.   All entries for each drawing must be received at least 72 hours prior to the drawing.   All entries received by the deadline date(s) and not picked in that drawing will be eligible entries for the subsequent drawing(s) (as applicable) related to this Sweepstakes.  Sponsor is not responsible for entries that are late, lost, incomplete, incorrect, illegible, damaged, misdirected or misrouted, or have postage due.  All Sweepstakes entries become the property of Sponsor and will not be returned.

ELIGIBILITY.  This Early Load Sweepstakes (this “Sweepstakes”) is open to individual persons (each, an “Entrant”) who are 18 years or older and legal residents of the 50 United States, including the District of Columbia.  Entrants must be competent and experienced skiers or boarders, able to ski or board safely in various conditions of snow, including deep powder snow, on at least intermediate level slopes, and must be willing to execute an affidavit of eligibility.  Officers, directors, employees, contractors, representatives, and agents of Sierra-at-Tahoe, Inc. and Booth Creek Ski Holdings, Inc., its parent company, subsidiaries and affiliates, are not eligible.  All federal, state, and local laws and regulations apply.  Void where prohibited or restricted.  Limit one entry per person.  By entering this Sweepstakes, participants agree to be bound by these Official Rules and the decisions of the Sponsor and/or its agents.  Odds of winning Prize depend on the number of eligible entries received.  Click [here] to see our Privacy Policy.  To request a copy of our Privacy Policy, write to Sierra-at-Tahoe Resort, Attention:  Early Load Sweepstakes Privacy Policy, 1111 Sierra at Tahoe Road, Twin Bridges, CA 95735.

OPT OUT.  By entering this Sweepstakes, Entrant agrees that, unless Entrant otherwise opts out by writing to Sierra-at-Tahoe Resort Early Load Sweepstakes Opt Out, 1111 Sierra at Tahoe Road, Twin Bridges, CA 95735, requesting Entrant’s name be removed from future mailings, Sponsor may use Entrant’s physical and/or e-mail address to contact Entrant regarding Sponsor’s offers and/or promotions that Sponsor believes may be of interest to Entrant. 

PRIZE.  Ten (10) Prize Winners will be chosen each drawing.  Each Prize Winner will receive an early load on one of our chairlifts (most likely West Bowl Express but subject to change at Sponsor's sole discretion) on a date to be determined by Sponsor in Sponsor's sole discretion.  Winners will need to arrive at the Resort on the Early Load day one hour before the lifts open to the public.  Each Winner will receive a continental breakfast and then line up for the chairlift ride.   Thirty (30) minutes before the Resort opens to the public, the Winners, along with a ski instructor and a ski patroller, will ride the lift for fresh tracks. It is anticipated that Winners will ski/snowboard two runs, with the ski instructor leading the way and the patroller following behind, ending at the bottom of the mountain.  The Early Load will end once the Resort chairs open to the public for the day. There is no cash value of each Prize.  Prize is not transferable.  No substitution or cash redemptions of Prize by Winner. 

DRAWING AND ODDS OF WINNING.  Sponsor will determine each Prize Winner by a random drawing of all entries properly received, scheduled to be held on each of the following dates: January 15, 2008; February 15, 2008; and March 15, 2008.  All drawings shall be conducted by Sponsor whose decisions are final and binding with respect to all aspects of this Sweepstakes.  The odds of winning each Prize will be determined by the number of eligible entries received prior to each drawing; entries received by the deadline date prior to a drawing and not picked in that drawing will be entered in the subsequent drawing(s).  Any Entrant who is selected in the drawing shall be deemed a potential winner, and such Entrant and his or her entry shall be subject to verification and the requirements of these Official Rules.  No Entrant shall be a Prize Winner unless and until his or her entry and any other submissions required by these Official Rules (including, without limitation, affidavits of eligibility publicity releases, liability waivers and/or IRS Forms W-9s) are validated. 

PRIZE WINNER/NOTIFICATION.  Sponsor will notify Prize Winner by e-mail and/or telephone.  Sponsor may require each Prize Winner to execute an affidavit of eligibility, publicity release (except where prohibited), liability waiver, affidavit of non-transferability and/or exculpatory agreements, prior to the delivery of the Prize.  If a Prize Winner does not respond to the Prize notification within 24 hours or is found to be ineligible, Sponsor will consider that Prize Winner to have forfeited the Prize, and Sponsor will not select an alternate winner.  All unclaimed Prizes will not be awarded.  Sponsor reserves the right to disqualify any Entrant for any reason, including, without limitation, if Entrant has not complied with these Official Rules or has interfered, in Sponsor’s sole opinion, with the proper conduct of this Sweepstakes.  Payment of any/all taxes is the sole responsibility of the Prize Winner.  Prior to receiving a Prize, each Winner will be required to comply with rules and regulations, specifically including but not limited to execution by Prize Winner of a liability waiver and release prior to receiving the Prize.

LIABILITY.  Prize acceptance constitutes permission (except where prohibited) to use Winner’s name and likeness for publicity purposes without compensation therefor.  Sponsor and its promotional and advertising agencies, and all respective officers, directors, employees, representatives and agents of each, shall have no liability and shall be held harmless by Prize Winner for any damage, loss of liability to persons or property, due in whole or in part, directly or indirectly by reason of the acceptance, possession, use or misuse of Prize or participation in this Sweepstakes.  Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend part or all of this Sweepstakes should unauthorized human intervention or other cause beyond the control of Sponsor corrupt or impair the administration, security, fairness or proper play of the Sweepstakes.  Sponsor and its promotion and advertising agencies, and all respective officers, directors, employees, representatives and agents of each, are not responsible for fraud or by any technical or human error which may occur in the processing of submissions which may limit an Entrant’s ability to participate in the Sweepstakes.  Sponsor reserves the right at its sole discretion to disqualify any individual Sponsor reasonably believes to have tampered with the entry process or with the operation of the Sweepstakes, or who is found to be acting in violation of these Official Rules.  This Sweepstakes is intended and limited for play in the United States and shall only be construed and evaluated according to United States law.

DISPUTE RESOLUTION; LIMITATION OF LIABILITY.  Each Entrant agrees to release, defend, indemnify and hold harmless Sierra-at-Tahoe, Inc., its real and personal property owner(s) and their respective parent companies and/or affiliates, and those working on their behalf, and each of their respective officers, directors, representatives, employees, agents, successors and assigns, from any damage, injury, death, loss or other liability, either at law or equity, whether known or unknown, asserted or non-asserted, that may arise from or in any way relate to Entrant’s participation in the Sweepstakes or the awarding, acceptance, use or misuse of a Prize.  Any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes shall be resolved individually, without resort to any form of class action.  This Sweepstakes shall be governed by and construed in accordance with the laws of the State of California, regardless of principles of conflicts of laws that may require the application of the laws of another jurisdiction.  Any action or litigation concerning this Sweepstakes shall be in the state court in and for Placer County, California.  Each Entrant expressly consents to the jurisdiction of and venue in such courts and waives all defenses of lack of jurisdiction and inconvenient forum with respect to such courts.  Each Entrant agrees to service of process by mail or other method acceptable under the laws of the state of California.  ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS PROMOTION.  ENTRANT HEREBY WAIVES ANY RIGHTS OR CLAIMS TO ATTORNEYS’ FEES, INCIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ENTRANT, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE.

GENERAL CONDITIONS.  This Sweepstakes is subject to all applicable Federal, State and local laws and regulations.  By entering this Sweepstakes, each Entrant agrees to be bound by these Official Rules and the decisions of Sponsor, and to accept delivery of a Prize based upon availability.  In addition, each Entrant represents and warrants that all information contained in his or her entry is true and accurate.  Sponsor is not responsible for any printing or typographical errors in these Official Rules.  Sponsor reserves the right to cancel this Sweepstakes at any time and substitute another promotion in its place.  Sponsor is not responsible for injury or damage to Entrants’ or to any other person's computer related to or resulting from participating in this Sweepstakes. In the event this Sweepstakes is compromised for any reason fraud, unauthorized intervention or other causes beyond the control of Sponsor) which, in the sole opinion of Sponsor, corrupts or impairs the administration, security, fairness or proper play of this Sweepstakes, Sponsor reserves the right in its sole discretion to suspend, modify or terminate this Sweepstakes.  This Sweepstakes is void where prohibited.

WINNERS’ LIST.  To receive the Winner’s List, send a self-addressed, stamped envelope (Vermont residents excepted) by April 1, 2008 to Sierra-at-Tahoe Resort Early Load Sweepstakes Winners List, 1111 Sierra at Tahoe Road, Twin Bridges, CA 95735.
